Biography
Brian Kracht advises companies engaged in resale, wholesale, distribution, construction, and service businesses. His corporate work includes entity formations, mergers, contract negotiation, and the preparation of distribution agreements, franchise agreements, employment agreements, non-compete agreements, confidentiality agreements, and commercial leases, along with general corporate matters.
Through the firm’s community association practice, Brian represents homeowners’ associations and condominium associations throughout Central Florida in all aspects of property management and governance. That work includes counsel on statutory obligations arising under Chapters 718 and 720 of the Florida Statutes, the drafting and interpretation of governing documents, and — when necessary — litigation on the association’s behalf in covenant-enforcement and collection matters, including lien foreclosures.
Brian has extensive experience with both transactional and litigation matters in real estate, including residential and commercial purchase and sale transactions, foreclosure and eviction actions, landlord-tenant issues, leases, and quiet-title actions.
He also litigates commercial matters, including construction disputes, construction lien foreclosures, contract disputes, commercial property foreclosures and evictions, and quiet-title actions, and assists clients with post-judgment collection efforts, discovery in aid of execution, and garnishments.
Brian additionally represents individuals in estate-planning matters, including the administration of estates under the Florida Probate Code.
A Florida native born in Miami, Brian earned his undergraduate degree from the University of North Carolina at Greensboro and graduated a semester early from the Barry University Dwayne O. Andreas School of Law. At Barry, he served on the Moot Court Board, worked as a certified legal intern with the Public Defender’s Office of the Ninth Judicial Circuit, and completed an externship as a Certified County Court Mediator.
